ChaseMe End User License Agreement

This End User License Agreement ("EULA") applies to ChaseMe, an iPhone and iPad app by Coding Mammoth BV. By downloading, installing, accessing, or using ChaseMe, you agree to this EULA.

This page is the current web version of the ChaseMe EULA. The latest published version is available at codingmammoth.com/chaseme-terms. A plain-text version of this EULA can also be provided in App Store Connect as the custom license agreement for the app.

Acknowledgement

This EULA is concluded between you and Coding Mammoth BV only, and not with Apple. Coding Mammoth BV, and not Apple, is solely responsible for ChaseMe and its content. This EULA may not be interpreted in a way that conflicts with the Apple Media Services Terms and Conditions and related usage rules.

Scope of license

ChaseMe is licensed, not sold, to you. Subject to this EULA, Coding Mammoth BV grants you a limited, non-exclusive, nontransferable, nonsublicensable license to use ChaseMe on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions and App Store usage rules. Where applicable, the app may also be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing.

Your use of ChaseMe must comply with the applicable Apple Media Services Terms and Conditions and App Store usage rules, which remain applicable in all cases.

  • You may not sell, redistribute, sublicense, rent, lease, or lend ChaseMe.
  • You may not copy, modify, reverse engineer, decompile, or create derivative works from ChaseMe except where applicable law expressly permits this despite the restriction.
  • All rights not expressly granted to you are reserved by Coding Mammoth BV.

App scope and intended use

ChaseMe is designed to read workout and distance data from Apple Health / HealthKit in read-only mode and present year-to-date comparisons and related insights.

  • ChaseMe compares your current calendar year-to-date distance with the same calendar day last year, split by activity type.
  • ChaseMe is intended for informational fitness use only.
  • ChaseMe requires HealthKit workout read access to function.
  • ChaseMe does not write data back to Apple Health / HealthKit.
  • Distance-based workouts only. Workouts without usable distance data are outside the app's intended scope.

Eligibility and age requirements

ChaseMe is intended for use by individuals aged 16 years or older. If you are under the age of 16, you may only use ChaseMe with the involvement and consent of a parent or legal guardian, who agrees to this EULA on your behalf.

Subscriptions and payments

ChaseMe may be offered with a free tier and with ChaseMe Pro subscription plans, including monthly and yearly options. Pro subscriptions are purchased through Apple In-App Purchases. Apple handles billing, payment collection, renewals, and related payment processing.

  • Pricing is shown in the App Store or in the app at the time of purchase.
  • Subscriptions may renew automatically unless cancelled through Apple.
  • Refunds, billing disputes, and subscription management are handled by Apple according to Apple's terms and processes.
  • RevenueCat may support entitlement checks, paywall presentation, and restore flows, but RevenueCat does not replace Apple as the payment processor for your in-app purchase.

HealthKit and privacy

ChaseMe requests read-only access to Apple Health / HealthKit workout and distance data so the app can calculate its comparisons and insights. ChaseMe does not write data back to HealthKit. Health and sport data used by ChaseMe stays local on your device and is not uploaded to Coding Mammoth servers. For more detail, see the ChaseMe Privacy Policy.

ChaseMe processes HealthKit data locally on your device. Coding Mammoth BV does not collect, store, or transmit your health or workout data to external servers. You remain responsible for any backups, device-level security, and access controls related to your device and Apple Health data.

ChaseMe may allow you to generate workout summary images locally on your device for personal export or sharing. These images may include workout-derived information such as date, distance, duration, pace, speed, and, where available, a route or location-related visual preview.

ChaseMe does not upload such exported images or the underlying workout data to Coding Mammoth BV servers as part of this feature. If you choose to export or share such images, you do so at your own discretion and are responsible for reviewing the content before sharing it. Once shared outside ChaseMe, such content may be processed by third-party apps, services, or platforms under their own terms and privacy practices.

ChaseMe relies on data provided by Apple Health / HealthKit, which may include data originating from third-party devices, applications, or sensors. Coding Mammoth BV does not verify, validate, or guarantee the accuracy, completeness, or reliability of such data. Any insights, comparisons, or calculations provided by ChaseMe are dependent on the quality and availability of this underlying data.

You should not rely solely on ChaseMe for making health, training, or fitness decisions without independently verifying the underlying data.

Maintenance and support

Coding Mammoth BV, and not Apple, is solely responsible for providing any maintenance and support services for ChaseMe, to the extent such services are offered or required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to ChaseMe.

Platform dependency and availability

Changes made by Apple, including updates to iOS, iPadOS, APIs, platform policies, or device behavior, may affect the availability, functionality, compatibility, or result in partial or complete loss of functionality of ChaseMe.

Warranty

To the maximum extent permitted by law, ChaseMe is provided on an "as is" and "as available" basis, with all faults and without warranties of any kind. Coding Mammoth BV disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement.

We do not guarantee that ChaseMe will always be available, error-free, accurate, complete, secure, current, or suitable for your specific goals, expectations, or circumstances.

ChaseMe is not guaranteed to be available at all times and may be subject to interruptions, errors, or downtime.

If ChaseMe fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price paid for the app, if any, in accordance with Apple's applicable terms and policies. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to ChaseMe, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty will be the sole responsibility of Coding Mammoth BV.

Product claims

You acknowledge that Coding Mammoth BV, and not Apple, is responsible for addressing any claims by you or any third party relating to ChaseMe or your possession and use of ChaseMe, including:

  • product liability claims;
  • any claim that ChaseMe fails to conform to any applicable legal or regulatory requirement; and
  • claims arising under consumer protection, privacy, or similar legislation, including in connection with ChaseMe's use of the HealthKit framework.

Intellectual property claims

In the event of any third-party claim that ChaseMe or your possession and use of ChaseMe infringes that third party's intellectual property rights, Coding Mammoth BV, and not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that intellectual property infringement claim.

Third-party services and terms

ChaseMe may rely on third-party services and frameworks. You must comply with any applicable third-party terms when using ChaseMe, including the Apple Media Services Terms and Conditions and any applicable internet, wireless, or device service terms.

To the maximum extent permitted by law, any third-party services, websites, or materials made available through or referenced by ChaseMe are used at your own risk. Coding Mammoth BV is not responsible for examining, evaluating, or guaranteeing the content, accuracy, availability, legality, or practices of third-party services, websites, or materials, and may change, suspend, remove, or restrict such integrations or references at any time.

Certain third-party services, such as infrastructure providers, communication tools, or subscription management tools, may be used by Coding Mammoth BV for limited operational purposes, including billing support, customer support, or service administration.

These services do not process, store, or have access to your HealthKit or workout data, which remains local on your device.

Legal compliance

You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Governing law and jurisdiction

This EULA and any non-contractual obligations arising out of or in connection with it are governed by the laws of Belgium, excluding its conflict of laws rules and excluding the United Nations Convention on Contracts for the International Sale of Goods.

To the extent permitted by applicable law, the courts of Antwerp, Belgium will have exclusive jurisdiction over any dispute, claim, or controversy arising out of or in connection with this EULA or your use of ChaseMe, without prejudice to any mandatory consumer protection rights that may apply under applicable law.

No medical or training advice

ChaseMe is an informational fitness app. It does not provide medical advice, diagnosis, treatment, coaching, or professional training advice. You remain responsible for your own health, training, safety, and decisions.

Limitation of liability

To the extent permitted by applicable law, the total liability of Coding Mammoth BV arising out of or in connection with ChaseMe will not exceed the amount you paid for the app or subscriptions in the twelve (12) months preceding the claim.

Nothing in this EULA limits liability where such limitation is prohibited by applicable law. Where liability cannot be excluded but may be limited, Coding Mammoth BV's liability will be limited to the greatest extent permitted by law.

Indemnification

You agree to indemnify and hold harmless Coding Mammoth BV from and against any claims, damages, liabilities, losses, and expenses arising out of or related to your use of ChaseMe, your violation of this EULA, or your violation of any applicable law or third-party rights, to the extent permitted by applicable law.

Force majeure

Coding Mammoth BV will not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including platform outages, network failures, changes imposed by Apple, or other unforeseen events.

Termination

This EULA remains effective until terminated by you or Coding Mammoth BV. Your rights under this EULA will terminate automatically if you fail to comply with it. Upon termination, you must stop using ChaseMe and delete all copies in your possession or control.

Changes to this EULA

We may update, change, suspend, discontinue, or restrict ChaseMe or parts of it at any time, with or without notice, to the extent permitted by applicable law.

We may update this EULA from time to time by publishing a revised version on this page. Where required by applicable law, material changes to this EULA will be communicated to you in an appropriate manner. Such changes will apply only from the effective date indicated. Material updates will apply prospectively from the time of publication or from any later effective date stated in the updated version, to the extent permitted by applicable law. Your continued use of ChaseMe after the effective date constitutes acceptance of the updated EULA, to the extent permitted by applicable law.

Apple as third-party beneficiary

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this EULA and that, upon your acceptance of this EULA, Apple will have the right, and will be deemed to have accepted the right, to enforce this EULA against you as a third-party beneficiary.
